2. Subject of the Agreement

The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and provision of airport transfer services that the Consumer orders electronically through the Seller's website [www.airporttransferticket.com] or other distance communication tools (phone, WhatsApp, email, etc.). This agreement is prepared in accordance with Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

3. Basic Features of the Service

The type, scope, price, payment method, location, and execution date of the service purchased are specified in the order confirmation and this agreement.

Examples:

Istanbul Airport to Sultanahmet Transfer – Private Sedan – September 23, 2025 / 10:00 AM / 2 passengers
Sabiha Gokcen Airport to Taksim Transfer – Shared Shuttle – September 25, 2025 / 2:00 PM / 4 passengers
Antalya Airport to Hotel Transfer – VIP Mercedes – September 30, 2025 / 6:00 PM / 3 passengers
Meet & Greet service and luggage assistance included

4. Payment Terms

The Buyer will pay the service fee through one of the payment methods offered by the Seller (credit card, bank transfer, Stripe, PayPal, etc.).
The reservation will only be confirmed upon receipt of full payment.
Once payment is confirmed, reservation details and pickup information will be sent electronically to the Buyer.
Payment processing may be performed by our Turkish entity (EMK Seyahat Acentası Turizm Ltd. Şti.) or our US entity (Xfergo LLC).

5. Execution of the Service

The airport transfer service will be provided on the date and time specified in the reservation.
Hotel pickup service is included and will be arranged according to the customer's accommodation.
The Seller is responsible for delivering the service safely, on time, and completely.
The Buyer is obliged to be ready at the hotel reception or designated pickup point at the specified pickup time.
Transfer time may vary depending on traffic conditions and distance.
Meet & Greet services include flight tracking, driver assistance with luggage, and professional welcome signage.

6. Right of Withdrawal and Cancellation Terms

According to Article 15 of Law No. 6502, the right of withdrawal does not apply to contracts related to accommodation, transportation, food and beverage, entertainment, or recreation activities.

However, Airport Transfer Ticket applies the following special cancellation and refund terms to ensure customer satisfaction:

6.1 Cancellation of Airport Transfer by Customer

Cancellation at least 24 hours before transfer time: Full refund (100%) will be provided.
Cancellation less than 24 hours before transfer time: No refund will be provided.
No-show (customer does not show up): No refund will be provided.

6.2 Cancellation of Transfer Due to Service Provider Issues

If the transfer is cancelled by the service provider due to vehicle breakdown, driver unavailability, or operational issues, the customer will receive one of the following:

Option 1: Full refund (100%), or
Option 2: Rescheduling to another date without any additional charge.

6.3 Cancellation Due to Force Majeure

In cases of force majeure (natural disasters, official bans, strikes, etc.), the customer will receive a full refund or rescheduling option.

7. Health and Safety Requirements

Airport transfers may not be suitable for:

Individuals with severe mobility limitations requiring special assistance beyond standard wheelchair accessibility
Passengers with excessive luggage beyond vehicle capacity
Unaccompanied minors (children under 12 years without adult supervision)

The Buyer is obliged to inform the Seller about:

Special requirements (child seats, wheelchair accessibility, excessive luggage)
Any health condition that may affect their ability to travel
Pet transportation needs (subject to approval)

The transfer operator reserves the right to refuse service if safety concerns arise.

8. Force Majeure

The parties shall not be held responsible in cases of force majeure such as natural disasters, strikes, wars, official bans, unforeseen technical failures, severe weather conditions, or traffic authority restrictions. In such cases, the service will be rescheduled or payment will be refunded.

9. Information and Declaration

The Buyer declares that:

They have read and accepted this agreement electronically
They have received preliminary information about the airport transfer service
They understand the health and safety requirements
They have made the payment appropriately
All provided information (flight details, hotel address, contact information) is accurate

10. Resolution of Disputes

For disputes arising from this agreement, within the monetary limits announced annually by the Ministry of Trade of the Republic of Turkey, Consumer Arbitration Committees or Consumer Courts located at the Buyer's place of residence have jurisdiction.

For international customers, disputes may be resolved through applicable international mediation or courts in Wyoming, USA, or Nevşehir, Turkey, depending on the contracting entity.

11. Effectiveness

By confirming the order, the Buyer is deemed to have accepted all the terms of this agreement. This agreement has been prepared electronically and accepted by both parties.
